This Privacy Policy describes how Barwaqt and its affiliate (“we,” “us,” or “Barwaqt,”), process personal information in relation to your use of the Barwaqt app. Thank you for choosing Barwaqt as your financial partner. We are committed to helping you achieve financial inclusion and providing you with a product that is a true enabler of financial growth. At our core, we believe that trust is the foundation of any strong relationship. To that end, we are dedicated to being transparent about how we use your information and protecting your right to privacy.

This Privacy Policy (the “Policy”) for Barwaqt users is to be read with and used with the Barwaqt Terms and Conditions of Service. All capitalized terms used in this Policy, unless specifically defined herein or the context requires otherwise, shall have the meanings given to them in the Barwaqt Terms and Conditions of Service. References below to “you” or “customer” shall mean any visitor, user, business partner, agent, supplier, vendor, or customer of Barwaqt or any and shall include a “User”.

Barwaqt is committed to protecting and respecting your privacy. This Policy has been formulated to assist you to understand how your personal information will be collected, stored, and processed by Barwaqt when you visit the Barwaqt App or website. Barwaqt may amend this Policy from time to time, with prior notice. Users and visitors to our website are advised to check this Policy on regular basis to keep up to date with any changes made hereto.

1. When this Policy applies

1.1.

This Policy applies when you use or subscribe to Barwaqt’s App and website to which this Policy is linked. This includes, data consists of personal and financial, video, advertising, internet and other products, services, and applications. This Policy also applies to Barwaqt approved app and its website.

1.2.

You must agree to and be willing to accept the terms of this Policy before you may visit or use any Barwaqt app.

1.3.

This Policy and any additional terms of use apply to you even if you are not our customer and you interact with us as part of running our business, such as by:

a. Barwaqt;

b. when using any of our products or services;

c. when entering any promotion;

d. when calling our help desk;

e. generally enquiring about our services or products.

1.4.

Depending on the product or services, you may also receive service-specific and/or terms. You will be legally bound by both this Policy and the service/region-specific term to the extent that you have accepted them when signing up for any service or product; therefore, you are required to read these terms carefully.

2. What information we collect

2.1.

Our app is designed to make it easy for you to access financial products and services, regardless of your financial background or credit history. To do that, we collect certain personal information from you, including your name, contact information, income details, and employment information. We use this information to verify your identity and creditworthiness, process your loan application, and communicate with you about your loan status. “Personal information” means any information that can be used by itself to uniquely identify, contact, or locate a person, or can be used with information available from other sources to uniquely identify an individual, such as personal information that you provide when you make use our services, set up a user account or otherwise interact with us or provide information, which includes but is limited to your name, e-mail address, phone/mobile number, country/city, occupation, SIM card, age, gender, username and encrypted password. All data will be uploaded and stored on our server in an encrypted form through the interface, but Barwaqt will not pass it on to third parties without user/borrower authorization.

2.2.

We collect information when a user/borrower registers with us via Barwaqt App or when user/borrower provides information and data by filling in the forms as part of loan application, or information and data provided in the course of any correspondence with us (for example, by e-mail or chat or helpline).

2.3.

We may collect information when you install the Barwaqt App to avail yourself of Barwaqt App services. Such service may contain a unique application number or when Barwaqt App searches for automatic updates, that number, and information about your installation, for example, the type of operating system, may be sent to us.

2.4.

We collect information and data you provide when you register to use services via Barwaqt App, download or register the same, subscribe to any of our services (such as applying for a loan), enter a promotion or survey, and when you report a problem with Barwaqt App.

2.5.

We may also collect your information from outside sources like credit reports and commercially available geographic and demographic information (third-party supplied information).

2.6.

Barwaqt and its authorized third parties may also collect, store and process personal information such as, financial information (details of bank account, credit card, debit card, or other payment instrument details), for providing our products, services and for use of our Barwaqt App.

2.7.

Means of obtaining and updating Personal data will be obtained and updated through Electronic means

2.8.

When you use our website or our Barwaqt App, we collect and store your information (personal information) which is provided by you from time to time by explicitly seeking permissions from YOU to get the required information.

a. Non-personal information
Including but limited to, a customer’s Internet Protocol (IP) address, operating system, browser type, and Internet service provider. This type of information does not identify the visitor or customer personally.

b. Technical information
Including the type of mobile device you use, unique device identifiers (for example, your device's IMEI or serial number), information about the SIM card used by the device, mobile network information, your device operating system, the type of browser you use, or your device's location and time zone setting (device information).

c. Customer Information
Only Camera.

d. Log Information
Details of your use of any of your applications or your visits to any of Barwaqt Platforms or websites including, but limited to traffic data, location data, weblogs.

e. Location
Barwaqt may also use GPS technology or other location services to determine your current location.

f. Installed Application
Barwaqt Collect and monitor specific information about your installed application on the app. We will upload it encrypted to our server https://d.barwaqtfintec.com/ and our external provider https://conversions.appsflyer.com/ to identify and analyze your behavior and risk against multiple loans to assess whether it can be processed the loan or not and help prevent fraud.

In any case, these entities will also be subject to confidentiality obligations in the handling of the information with the legal limitations imposed by the applicable laws on the matter in the jurisdiction where it is collected, filed, processed, or transmitted.

2.9.

You agree that Barwaqt may collect, store and process all of the information mentioned above, which we may collect as part of your interaction with Barwaqt, including third-party supplied information

3. Tracking and Cookies

3.1.

"Cookies" are small text files transferred by a web server to a user’s hard drive and thereafter stored on their computer. The types of information a cookie collects include the date and time users visited, their browsing history, preferences, and username.

3.2.

Barwaqt may use Cookies to manage our users’ sessions and to store preferences, tracking information, and language selection. Cookies may be used whether customers register with us or not.

3.3.

In some instances, our third-party service providers may use cookies on the website. We cannot control or access cookies used by third-party service providers. This Policy covers only Cookies used by us and not any Cookies used by third parties.

3.4.

Customers may have the ability to either accept or decline the use of Cookies on their computer, whether registered with us or not. Typically, you can configure your browser to not accept Cookies. However, declining the use of Cookies may limit your access to certain features of the website and /or Barwaqt Platform. Cookies help us to provide you with a good experience when you use the Barwaqt or browse any of the websites and also allow us to improve the Barwaqt and our websites.

3.5.

You can withdraw your consent for further collection of this information at any time by logging out and uninstalling the Barwaqt mobile from your device.

4. Use made of Customer Information

4.1.

Information collected by us shall be used to determine whether or not to provide a financial service or product to the customer, the amount of such exposure, and the terms and conditions applicable to such services.

4.2.

We may also use a third-party payments services provider or payments processing company to process payments and repayments, transfer money to your Operative Account or any other user account, process other payments, and provide additional products and services, and may therefore disclose your information to such third-party payments’ services provider.

4.3.

We use your information to power our services and to improve your experiences and interaction with Barwaqt. We use your information to provide, support, improve, protect, and analyze, for our and services; to communicate with you about your service or applications; to market our products and services; to detect and avoid fraud; for advertising; and research purposes.

We may use the information we collect from you when you avail services from us, sign up for our newsletter, respond to a survey or marketing communication, surf the website or Barwaqt application if you register for an online account with us, download and register on our app or use certain other site features in the following ways:

a. personalizes your experience and allows us to deliver the type of content and product offerings in which you are most interested;

b. improves our website/app in order to better serve you;

c. allows us to better service you in responding to your customer service requests;

d. administers a contest, promotion, survey, or other site feature;

e. asks for ratings and reviews of services or products; and

f. follows up with them after correspondence (live chat, email, or phone inquiries).

4.4.

This means we may:

a. record details about the services you use from us;

b. send you product or service-information messages (we may send you messages to confirm your order and tell you about any changes that might affect your service, like when we have infrastructure work planned or need to fix something);

c. let you create and log in to the online accounts we run;

4.5.

In addition, we use the following information to provide products and services and manage your account:

a. your contact details and other information to confirm your identity and your communications with us. This includes your Personal Information and other relevant credentials such as credit reporting;

b. your payment details and financial information such information from Credit Bureaus;

c. your communications with us, including emails, webchats, and phone calls. We will also keep records; and

d. information from cookies placed on your connected devices that we need so we can provide a service.

4.6.

We may disclose some or all of the data we collect from you when you download or use the Barwaqt to connect to mobile wallet providers, credit bureaus, or other partner financial institutions. We may disclose your personal information to any member of our group, which means our subsidiaries, our ultimate holding company, and its subsidiaries.

4.7.

We may disclose your personal information to any local or international law enforcement officers or competent regulatory or governmental agencies, in good faith belief that such disclosure is reasonably necessary to enforce any terms and conditions and/or this Policy, to assist in the prevention, detection, investigation or prosecution of criminal activities or fraud.

4.8.

We shall use your data for the purposes of compiling statistics relating to our user base or financial product or services and may disclose such information to any third party for such purposes, provided that such information will always be anonymous.

4.9.

We may use other third-party companies to monitor site traffic, which may, in some instances, store customer information. Where we use another organization, we still control your personal information, and we have strict controls in place to make sure it’s properly protected.

4.10.

We may also disclose or transfer your personal information to third parties in the event that:

a. Barwaqt is involved in a merger, bankruptcy, acquisition, reorganization, or sale of assets, in which case we may disclose your data to the prospective seller or buyer of such business or assets;

b. Barwaqt or substantially all of its assets are acquired by a third party, personal data held by it about its customers will be one of the transferred assets;

c. Barwaqt is under a duty to disclose or share your personal data to comply with any legal or regulatory obligation or request; or

d. to enforce our Terms and Conditions and other agreements or to investigate potential breaches; report defaulters to any credit bureau or publish statistics relating to the use of the Barwaqt Platform, in which case all information will be aggregated and made anonymous.

5. Security Practices

5.1.

While no organization can guarantee perfect security, we are continuously implementing and updating administrative, technical, and physical security measures to help protect your information against unlawful or unauthorized access, loss, destruction, or alteration. We adopt reasonable security practices and procedures, including technical, operational, managerial, and physical security controls in order to protect your personal information from unauthorized access, or disclosure while it is under our control. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential.

5.2.

The data and information we collect from you may be transferred to, and stored in Pakistan. The staff members at the destination may be engaged in the fulfillment of your requests. By submitting your data, you agree to this transfer, storing, or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy.

5.3.

Our security practices and procedures limit access to personal information on a need-only basis. Further, our employees are bound by a code of conduct and confidentiality policies that obligate them to protect the confidentiality of personal information.

5.4.

We maintain the security of our Barwaqt Platforms, however, for reasons outside of our control, security risks may still arise. Any personal information transmitted to us or from our online products or services will therefore be at your own risk. However, we will use all reasonable efforts to ensure the security of your information. We observe reasonable security measures to protect your personal information against hacking and virus dissemination.

5.5.

Where we have given you (or where you have chosen) a password that enables you to access certain parts of our Barwaqt app, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

5.6.

You agree that Barwaqt or any of its affiliates, associated or related entities, employees, directors, shareholders, agents, representatives, etc. shall have no liability towards you in case of any unintended security breach which results in unauthorized access to, or disclosure of, your information. You agree to waive, to the fullest extent permitted by law, all of your rights to seek damages or otherwise hold Barwaqt and its related entities liable for any security breach resulting in disclosure or unauthorized access to your information.

6. Your rights

6.1.

You can exercise any of the rights described in this section consistent with applicable law. We may ask you to verify your identity and request before taking further action on your request. You can access and update some of your personal information through your Account settings. You are responsible for keeping your personal information up to date.

6.2.

You can request that your personal information be deleted. Please note that if you request the deletion of your personal information, or if your account is suspended, terminated, or voluntarily closed:

a. We may retain your personal information as necessary for a period of five (05) years for our legitimate business interests, such as the prevention of money laundering, fraud detection and prevention, an enhancing safety. For example, if we suspend an Account for fraud or safety reasons, we may retain information from that Account to prevent that Member from opening a new Account in the future.

b. We may retain and use your personal information to the extent necessary to comply with our legal obligations. For example, we may keep information for tax, legal reporting, and auditing obligations.

c. Because we take measures to protect data from accidental or malicious loss and destruction, residual copies of your personal information may not be removed from our backup systems for a limited time.

7. Sharing & Disclosure

7.1.

Where you provide consent, we share your information as described at the time of consent, such as when authorizing a third-party application or website to access your account or participating in promotional activities by us or third parties.

7.2.

We may disclose your information to courts, law enforcement, governmental or public authorities, tax authorities, authorized third parties, or other agencies, if and to the extent we are required or permitted to do so by law or where disclosure is reasonably necessary to: (i) comply with our legal obligations, (ii) comply with a valid legal request (such as a subpoena or court order) or to respond to claims asserted against us, (iii) respond to a valid legal request relating to a criminal investigation to address alleged or suspected illegal activity or to respond to or address any other activity that may expose us, you, or any other of our users to legal or regulatory liability (iv) enforce and administer our agreements or (v) protect the rights, property or personal safety of Barwaqt, its employees.

7.3.

Where appropriate, we may notify you about legal requests unless: (i) providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law, or (ii) we believe that providing notice would be futile, ineffective, create a risk of injury or bodily harm to an individual or group, or create or increase a risk of fraud upon or harm to Barwaqt, or expose Barwaqt to a claim of obstruction of justice. Where legally required or permissible according to applicable law, we may disclose information to tax authorities or other governmental agencies for the purpose of the tax authorities’ determination of proper compliance with relevant tax obligations.

7.4.

If Barwaqt undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer, or share some or all of our assets, including your information in connection with such transaction or contemplation of such transaction (e.g., due diligence). In this event, we will notify you before your personal information is transferred and becomes subject to a different privacy policy.

8. Changes to this privacy policy

We reserve the right to modify this Privacy Policy at any time in accordance with applicable law. If we do so, we will post the revised Privacy Policy and update the “Last Updated” date at the top. In case of material changes, we will also provide you with notice through a pop-up window in the application and send notifications to your mobile phone before the effective date. If you disagree with the revised Privacy Policy, you can cancel your Account. If you do not cancel your Account before the date the revised Privacy Policy becomes effective, your continued access to or use of the Barwaqt will be subject to the revised Privacy Policy.

9. Contact information and responsible entities

Any disputes regarding this Policy shall be subject to the Terms and Conditions of Barwaqt, including but not limited to any provisions related to indemnification, limitation of liability relating to damages, choice of law, and dispute resolution forum. We ask you to first submit any such complaints directly to us at the relevant customer services desk or helpline.
